How it's calculated
The Employment Act sets minimum leave for every employee with a contract of service. Annual leave and ordinary sick leave rise with the length of service with the same employer; the rest are fixed.
- Annual leave, section 60E: 8 days under two years of service, 12 days from two to under five, 16 days from five years.
- Sick leave, section 60F: 14, 18 or 22 days on the same service bands, plus 60 days a year when hospitalisation is needed.
- Maternity leave, section 37: 98 consecutive days per confinement. Paternity leave, section 60FA: 7 consecutive days for married men with 12 months of service, for up to five confinements.
- Public holidays, section 60D: 11 paid gazetted holidays a year.
For a part year, annual leave is pro-rated: days = full-year entitlement × completed months ÷ 12, with fractions under half a day dropped and half a day or more rounded up.
Worked example (the default inputs). Three years of service falls in the two-to-five-year band: 12 days of annual leave, 18 days of sick leave and up to 60 days of hospitalisation leave a year, plus 98 days of maternity leave or 7 days of paternity leave per confinement and 11 paid public holidays.
If the same employee leaves after seven completed months of the year, the annual leave is 12 × 7 ÷ 12 = 7 days.
The eleven public holidays
Five of the eleven are fixed by the Act: National Day, the Birthday of the Yang di-Pertuan Agong, the Birthday of the Ruler or Yang di-Pertua Negeri of the state where you mainly work (or Federal Territory Day), Workers’ Day and Malaysia Day. The employer chooses the other six from the gazetted holidays and must display them before the year starts. A holiday that falls on a rest day or on another holiday is replaced by the next working day. Any additional holiday the government declares for a particular year is also a paid holiday.
When leave can be lost
Annual leave can be forfeited if you are absent without permission or reasonable excuse for more than 10% of the working days in the year it accrues. Employers usually set a deadline for taking each year’s leave, and leave accrued in the year employment ends can be taken or paid out. Sick leave needs a certificate from a registered medical practitioner or the employer’s panel doctor, and the employer should be told as soon as possible. Keep copies of every certificate and leave approval.
FAQ
How many days of annual leave am I entitled to in Malaysia?
Under section 60E of the Employment Act 1955, at least 8 days a year if you have worked for the employer for less than two years, 12 days from two years up to five, and 16 days from five years. Annual leave is in addition to rest days and public holidays. Your contract can give more, and many do.
How is annual leave pro-rated?
In the year your employment ends, the entitlement is in proportion to the completed months of service: a 12-day entitlement and seven completed months gives 7 days. A fraction of less than half a day is dropped, and half a day or more counts as a full day. Many employers use the same method in the year you join.
How much sick leave do I get?
Section 60F gives 14 days a year for less than two years of service, 18 days from two to five years, and 22 days from five years, when no hospitalisation is needed, plus up to 60 days a year when hospitalisation is necessary. Since the 2022 amendments took effect on 1 January 2023, the 60 days are in addition to the ordinary sick leave rather than inclusive of it. A medical certificate from a registered practitioner is required.
What maternity and paternity leave does the law give?
Female employees get at least 98 consecutive days of maternity leave for each confinement, with maternity allowance if they have worked for the employer for at least 90 days in the nine months before and are not already the mother of five or more surviving children. Married male employees get 7 consecutive days of paid paternity leave per confinement, for up to five confinements, after 12 months with the employer and with notice to the employer.
Do these rules apply if I earn above RM 4,000?
Yes. Since 1 January 2023 the leave provisions in the Employment Act, including annual leave, sick and hospitalisation leave, maternity and paternity leave and the eleven paid public holidays, apply to every employee under a contract of service regardless of wage. The RM 4,000 threshold only switches off overtime, rest day and holiday work pay, shift allowance and termination benefits.
